Section 18 of the Return to Work Act 2014: Suitable Employment

The Return to Work Act 2011 presents a unique obligation for employers to provide suitable employment to injured workers beyond their entitlement periods.  This seminar will explore the obligations imposed upon employers and the mechanism by which workers can make applications for suitable employment.  It will also include a practical discussion from an employer’s perspective as to how to manage a section 18 application and the interplay between the industrial and employment issues with the medical evidence as to the worker’s functional capacity.  Jodie has advised employers in numerous section 18 matters in the SAET.  She is in a position to explain how that process works and the traps and pitfalls for the parties as well as the new cost provisions which were Gazetted on 6 February 2018.

In addition to the above, Jodie will introduce the next speaker, Toby Roberts, from Body Corporate Physio to discuss the importance of obtaining a functional capacity evaluation in managing a section 18 dispute, as well as the practicalities of implementing the assessment on a worker who has an injury.
